Terms of contract of Ekokarelia Oy

1. General terms
Realisointikarelia.fi is a marketplace of Ekokarelia Oy (Business ID: 2789343-5). These terms of contract apply to the business relations between Ekokarelia Oy and its clients. The services and products supplied by Ekokarelia Oy are also governed by the terms of contract defined by the relevant service provider. Ekokarelia Oy has the right to update these terms of contract without prior notice. Orders are subject to the terms of contract in force at the time of order, which are available on the website of Ekokarelia Oy.
Ekokarelia Oy shall not be liable for damage caused by a force majeure situation. Unforeseeable events or changes of circumstances that are beyond the control of Ekokarelia Oy are considered as force majeure situations. Ekokarelia Oy shall be obligated to notify the client of any force majeure situations that may occur without delay.
2. Client and data protection
Ekokarelia Oy welcomes all private and corporate clients. The business relations are subject to applicable Finnish and EU legislation regarding consumer trade, marketing, and advertising. These terms of contract shall primarily apply to commercial agreements concluded between corporate clients and Ekokarelia Oy, whereas the Finnish Sale of Goods Act is complied with in other respects.
When placing an order, the client is obligated to provide their full contact information, which includes at least their name, address, and telephone number, and possible their email address for consumer customers. For corporate clients, the required information includes the name, telephone number, and email address of the contact person and the business ID, postal address, telephone number or numbers, and the invoicing address of the company where necessary.
Client information is stored in the client register of Ekokarelia Oy, which includes information that is used to maintain customer relations. Furthermore, Ekokarelia Oy and its group companies shall have the right to process data included in the register and disclose the data to third parties for legitimate purposes (such as direct marketing) in accordance with applicable legislation.
The privacy statement under the General Data Protection Regulation is available at Realisointi Karelia, Siltakatu 18, 80100 Joensuu, Finland. Clients can prohibit the processing and use of their data for marketing purposes and review the data pertaining to themselves by contacting the customer service of Realisointi Karelia. 3. Price list
The prices are presented exclusive of VAT and delivery costs, unless otherwise stated. If prices that are obviously incorrect are included in the price list, the product will not be sold at the markedly lower price if the customer can be expected to have realized the incorrect nature of the price.
Prices are always reviewed as the order is processed. The price must match the pricing of an in-store product unless otherwise stated in an online store offer.
Ekokarelia Oy or the suppliers it uses shall not be liable for any delays caused by unforeseeable changes occurring outside of their sphere of influence.
Ekokarelia Oy reserves the right to restrict the sale of products in exceptionally large quantities.

We aim to process all complete orders within 48 hours of receiving the order. Complete order refers to an order that only includes products that are in stock and have been reserved for the order, has an accepted delivery method and payment method, and has been paid in full.
The payment must be made before the order can be processed even if the chosen payment method is bank transfer.
Products ordered with in-store pickup must be collected within 7 days of placing the order. Any products that are not collected, are repossessed by Ekokarelia Oy without the payment being refunded.
If an order includes a product whose availability is poor or whose delivery is delayed due to reasons beyond the control of Ekokarelia Oy, Ekokarelia Oy shall not be obligated to reserve the remaining products in the same order for the customer.
The consumer may choose between postdelivery of the delayed item or cancellation of
the order. The delivery cost of the postdelivery is charged normally in accordance with the existing price list at the time. The products included in the order are reserved for a maximum period of 7 days, after which the order is cancelled unless the customer accepts postdelivery in accordance with the terms and conditions of Ekokarelia Oy.
The delivery prices apply to shipments in Finland. A separate price list is used for international shipments.

6. Returns & cancellations
Ekokarelia offers its customers a 14-day right of return. Products can be returned directly to a store or by mail at the customer's expense. If customer cancels his/hers order, postage won't be returned.
You have a 14-day period to consider your purchase. We recommend that you ensure that the product and the included accessories, instructions, and particularly the packaging remains in good condition until you decide whether you wish to keep the product. According to the law, the purchaser is responsible for the reduction in value if they have used the product.
We ask you to keep all documentation related to a returned order safe until Realisointi Karelia has notified you of having received the return.
Restrictions of the right of return are determined in accordance with chapter 6, section 16 of the Finnish Consumer Protection Act: the right of return does not apply to games, films, software, or other products delivered in sealed packaging if the product packaging has been opened. Hygiene and personal care products cannot be returned if the packaging has been opened as such products cannot be resold due to their nature. Hygiene and personal care products include, for example, epilators, shavers, hair trimmers, nose and ear hair trimmers, hair care devices and clippers, electric toothbrushes and oral hygiene devices, thermometers, blood pressure monitors, and glucometers as well as breathalyzers, earphones and hands-free devices, and diapers and similar childcare products.
Service products or other digital contents are not subject to the right of return under the Consumer Protection Act if the service has been provided in full or the delivery of digital content in an electronic form has commenced once you have consented to the commencement of the delivery and if you have been informed of the fact that these products cannot be returned in advance.
Any returned products must be packaged carefully.
7. Warranty, support, and liability for defects
Used products are sold without warranty, as is
and in their current condition. Ekokarelia Oy will not be held accountable if the products are damaged because of freight or shipping. Ekokarelia Oy will not be held accountable
if the customer has not paid for fragile parcel of the products. If the products are damaged because of freight or shipping, Ekokarelia Oy will refund the price as the shipping company refunds to Ekokarelia Oy.
The customer is obligated to present a certificate of purchase, receipt, or another form of proof of the purchase location and date when returning a product or making a complaint of a defect in a product. Ekokarelia Oy reserves the right to charge the purchaser for the cost of searching for the receipt.

Dispute resolution and place of jurisdiction: Consumer customers have the right to bring any disputes arising from this agreement to the Consumer Disputes Board (www.kuluttajariita.fi). Before bringing a matter to the Consumer Disputes Board, the consumer should first contact the Consumer Advisory Services (https://www.kkv.fi/en/consumer-advice/). In addition, consumers can also utilize the Online Dispute Resolution forum maintained by the European Commission (https://ec.europa.eu/odr).
A customer can bring an action concerning a dispute arising from the debt relationship based on the agreement against Ekokarelia Oy in the district court of the domicile of Ekokarelia Oy or the district court of the Finnish municipality in whose jurisdiction the customer resides. If the Customer does not reside in Finland, any disputes shall be resolved by the district court of the domicile of Ekokarelia Oy.
Fees of representatives shall not be reimbursed, as the Consumer Advisory Services and the Consumed Disputes Board provide free service for dispute resolution.
9. Additional conditions for corporate clients
Ekokarelia Oy shall not be liable for direct or indirect loss, damage, or loss of revenue caused by a product and/or service. Ekokarelia Oy liability shall be limited to the contents of these terms of contract. The liability for product defects shall be limited to a possible refund of the purchase price, from which the benefit received by the purchaser has been deducted.
Ekokarelia Oy shall not be obliged to fulfill the contract if it encounters a force majeure situation that it cannot reasonably be expected to overcome. Ekokarelia Oy shall not be obliged to compensate the client for any damage or costs it has incurred in the event of a force majeure situation and shall be entitled to cancel the contract.
When placing an order and/or a request for a quotation, the client accepts Ekokarelia Oy's terms of contract without dispute. Any purchase contract terms used by the client shall not apply in case of conflict with Ekokarelia Oy's terms of contract.
